Welcome to ChiwaBots (hereinafter referred to as "the Service"). The Service is operated by Chiwa Studio (hereinafter referred to as "the Company" or "we"). Please read the following Terms of Service (hereinafter referred to as "these Terms") carefully before using the Service.
1. Acceptance of Terms
By logging in via your Twitch account, browsing, or using any part of the Service, you acknowledge that you have read, understood, and agreed to accept all contents of these Terms. If you do not agree to any part of these Terms, please stop using the Service immediately.
If you are under 18 years old (or the age of majority in your jurisdiction), you must use the Service only after your legal representative (parent or guardian) has read, understood, and agreed to these Terms.
2. Service Content
ChiwaBots is an automation bot and analysis tool designed for Twitch streamers. Our services include but are not limited to:
- Event notifications (follows, subscriptions, bits, etc.)
- Chat management and analysis
- Channel points and mini-games
- Giveaways and song request systems
- Streamer utility tools (e.g., marathon timers, daily check-ins)
We reserve the right to modify, suspend, or terminate part or all of the Service at any time without prior notice.
3. Account Registration and Security
- Twitch Login: The Service requires authorization via your Twitch account. You agree to authorize us to access your Twitch public data and features within the scope of permissions to provide the Service.
- Account Security: You are responsible for maintaining the security of your account. The Company is not liable for any loss caused by your failure to properly safeguard your account or by third-party hacking.
- Accurate Information: You should ensure that all information provided to the Service is true, accurate, and complete.
4. Third-Party Service Terms
- Twitch: The Service operates on the Twitch platform. By using the Service, you agree to be bound by the Twitch Terms of Service and Twitch Community Guidelines.
- YouTube: The song request system uses YouTube API Services. By using the Service, you agree to be bound by the YouTube Terms of Service, and you also agree to the Google Privacy Policy.
The Company is not responsible if your account (Twitch or YouTube) is suspended or restricted due to your violation of the aforementioned third-party platform regulations.
5. User Conduct
You agree not to use the Service to:
- Send spam, malicious software, or viruses.
- Play content via the song request system that violates copyright, or contains pornography, violence, or hate speech.
- Upload, via the media library, image or audio assets that infringe others' copyright, likeness, or privacy, or that contain pornography, violence, or hate speech.
- Interfere with or disrupt the Service's servers or network connections.
- Collect personal data of other users without authorization.
- Engage in any behavior that violates the laws of Taiwan (R.O.C.) or your local laws.
In case of violation, we reserve the right to suspend or terminate your access to ChiwaBots without prior notice, and reserve the right to pursue legal action.
Right to Remove Infringing Content: For assets you upload and that are publicly delivered via our content delivery network (CDN), if we determine in our judgment that they may infringe rights, be unlawful, or violate this Conduct policy, we may remove or disable such content without prior notice, and may clear any settings that reference it. Rights holders who discover suspected infringing content may report it by emailing [email protected] with the content URL and proof of rights; we will handle it in accordance with the law.
6. Paid Services and Refund Policy
- Service Subscription and Purchase: Certain features of this Service require a paid subscription. A subscription is a service for a period of time: the period starts running from the date of payment and elapses regardless of how much you actually use it.

Types and Nature of Credits:
- "Free / Trial Credits": Credits granted by the Company at no charge. They have an expiration date (shown when claimed). Any unused portion expires automatically at that date and cannot be transferred, redeemed for cash, or refunded.
- "Plan Quota": Consumable service credits included with your subscription plan, on a 30-day billing cycle (starting from the date of subscription payment). Upon expiry of each 30-day cycle, any unused Plan Quota automatically expires (resets to zero) and does not roll over to the next cycle, and cannot be transferred, redeemed for cash, or refunded.

"Period Capacity" (add-on): An increase to your capacity for the current period, purchased while a service period is running. It raises the amount of credits available to you within the current period and is settled together with that period; it does not carry over to the next period.
- Period Capacity is an adjustment to the capacity of the current service contract. It is not stored value, not an electronic payment instrument, and not a gift certificate or voucher. What you purchase is service capacity within the period, not a prepaid balance held indefinitely.
- Period Capacity may only be purchased while you have an active service period (an active subscription). The purchase option is not offered without one.
- Period Capacity cannot be transferred, traded, or redeemed for cash.
- "Legacy Add-on Points": Add-on points that you purchased before July 29, 2026 (the date the "Period Capacity" model took effect), or that were migrated from the earlier version of this Service. In reliance on the commitment made when they were purchased, Legacy Add-on Points retain no expiration date: the Company will not impose an expiry on them, will not force their conversion, and will not force their refund. They remain until consumed.
- Consumption Order: Credits are consumed in the order "Free / Trial Credits → Plan Quota (including Period Capacity) → Legacy Add-on Points", so that time-limited credits are used first. The number of credits consumed per request is as displayed on the "AI Bot" page in the dashboard (that page also shows the effective date of the current rate); any change to the rates will be announced in advance with a stated effective date.
- Promotions: The Company may from time to time offer promotions, including but not limited to reducing the credits consumed per request during a promotional period or granting additional capacity at the time of purchase. If a promotion is offered, its period, content and eligibility are as announced by the Service or displayed in the dashboard at the relevant time; every promotion states the period for which it applies, and the Company reserves the right to modify, suspend or terminate any promotion. Neither offering a promotion nor reverting to the published rate when the promotion period ends constitutes a change to the rates described above, and the advance-notice procedure for rate changes does not apply to either.

Refund Policy:
- Credits already consumed are non-refundable. Once the AI begins processing a request, that request is deemed performed and the credits consumed; they cannot be restored or refunded.
- Where the Service cannot be provided for reasons attributable to the Company, the price of the portion you have not yet consumed will be refunded.
- Refunds of subscription fees are calculated pro rata by the number of service days not yet elapsed.
- If the Service ceases operation, the Company will give notice at least 30 days before the termination date and will refund any unconsumed Legacy Add-on Points at the reference refund unit price described below.
- Reference Refund Unit Price: Refunds of Legacy Add-on Points are calculated at a fixed unit price that is no lower than the per-credit price of the smallest add-on pack currently offered, regardless of how those points were acquired (self-purchased, gifted by another user, or granted by the Company). A fixed reference price is used instead of the individual price actually paid because the records for legacy points do not include an individual purchase price; the reference adopted is the one most favourable to the consumer.

Exclusion of the Right of Withdrawal (7-day cooling-off period):
- The AI-generated content provided by this Service constitutes "digital content not supplied on a tangible medium" or "online services completed upon provision." Under the applicable regulations, the right of withdrawal under Article 19(1) of the Consumer Protection Act is excluded from the moment credits from that purchase are first consumed.
- Before that first consumption, you may still exercise the right of withdrawal: merely completing payment and having credits credited to your account does not itself trigger the exclusion.
- Gifting and Transfer: The Company may offer a feature allowing a purchaser to designate a recipient account at the time of purchase (whether and to what extent this is offered is as announced by the Service at the relevant time). However, once credited to an account, credits cannot be transferred, traded, or redeemed for cash, and cannot be moved between accounts.
- Third-Party Payment Disclaimer: If the Service provides sponsorship/donation features, ChiwaBots serves only as an information display tool. The actual financial transaction occurs between you and third-party payment platforms. The Company does not intervene in, nor is it responsible for, any financial disputes or refund requests between you and your audience or third parties.
- Tip Page Service Fee: If you enable the Tip Page (public tipping) feature, the Company will charge a service fee on payments received through it, settled monthly: (monthly gross receipts minus payment provider fees minus a monthly exemption) multiplied by the service fee rate; balances below the billing threshold roll over to the next month. The current rate, exemption and billing threshold are as shown on the Service fee page in the dashboard. The deduction of provider fees is a courtesy and is not guaranteed permanently. Overdue balances will suspend the Tip Page feature; it is restored automatically once paid. The Company may from time to time offer promotions that waive or reduce the service fee (such as an introductory free period at launch); promotion periods and contents are as shown in the dashboard, and the Company reserves the right to adjust, suspend or terminate any promotion at any time. Changes to billing parameters such as the fee rate, exemption or billing threshold will be announced in advance with a stated effective date; continued use after that date constitutes acceptance of the updated terms and the new parameters apply automatically; if you do not agree, disable the feature before the effective date. The full terms are shown in the dashboard and must be explicitly accepted before use (current version 2026-07-05).
7. AI Service Usage Guidelines
- Content Generation Disclaimer: AI-generated content is produced by automated models and does not represent the Company's stance. We do not guarantee the absolute accuracy, truthfulness, or suitability of the responses.
- User Responsibility: You agree to perform a final review of the content produced by the AI. If the AI-generated content violates Twitch Community Guidelines or laws, you shall bear all relevant responsibilities.
- Prohibition of Abuse: It is strictly prohibited to use inductive prompts (prompt injection) to attempt to extract the Service's source code or system configuration, or to conduct large-scale automated attacks. In case of violation, the Company reserves the right to terminate your service immediately without refund.
8. Intellectual Property Rights
- Company Rights: All intellectual property rights in the architecture, code, interface design, and trademarks of the Service belong to the Company.
- User Content: You retain copyright ownership of the content (e.g., custom command responses, images, audio assets) you upload or transmit via the Service. However, you grant us a global, royalty-free license to use, host, reproduce, cache, and publicly transmit via a content delivery network (CDN), and display this content to the extent necessary to provide the Service. You represent and warrant that you own or have obtained all necessary rights to the content you upload and that it does not infringe any third party's rights. You further acknowledge that assets uploaded via the Service's media library are publicly delivered via CDN without account authentication (so they can be loaded by browser sources such as OBS); anyone who knows the URL can access them, so you must not upload private content or content you are not authorized to use.
9. Disclaimer
- No Warranty: The Service is provided on an "as is" and "as available" basis. We do not guarantee that the Service will be uninterrupted, error-free, or completely secure.
- Third-Party Reliance: The Service relies heavily on the Twitch and YouTube APIs. The Company is not liable for compensation if ChiwaBots fails to function properly due to third-party API changes, malfunctions, or service termination.
10. Limitation of Liability
To the maximum extent permitted by law, the Company shall not be liable for any direct, indirect, incidental, punitive, or consequential damages (including but not limited to data loss or loss of profits) resulting from the use of, or inability to use, the Service.
11. Modification of Terms
We reserve the right to modify these Terms at any time. The modified terms will be published on this website and take effect from the date of publication. Your continued use of the Service after modification constitutes your acceptance of the modified terms.
12. Governing Law and Jurisdiction
The interpretation and application of these Terms, and any disputes related to them, shall be governed by the laws of Taiwan (R.O.C.).
